A question for pilots?

What doctrine states that precision bombing of"family compounds", cluster/mine bombing is not a war crime? I'm a former Marine and wonder how you can do your missions without knowing you're killing non-combatants. It was simple for us. We had a real good idea of who was trying to kill us. Was Dresden, GE the first use of "acceptible collateral damage" ?
